1. Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you ("User," "Client," or "you") and GrowTap ("we," "us," or "our"), concerning your access to and use of the growtap.net website as well as any other media form, hardware, or service related, linked, or otherwise connected thereto.

2. Hardware, Provisioning, and Cloud Routing Services

GrowTap provides proprietary physical NFC-enabled smart table stands, counter pucks, and smart cards engineered to work in tandem with the GrowTap Cloud routing infrastructure, dynamic DNS network, and Review Guard™ system.

• Hardware Ownership & Provisioning: The one-time hardware fee ($25 per unit) covers precision acrylic or matte finish manufacturing, custom laser etching, and cryptographic chip programming. Upon delivery, the physical hardware unit remains the property of the merchant.
• Cloud Routing & Active Service: Dynamic NFC chip redirection, Review Guard™ negative review interception, real-time manager alerts, and traffic analytics require an active GrowTap software subscription. If an account is cancelled or lapses due to non-payment, cloud DNS resolution and dynamic routing for all associated hardware units will be deactivated immediately, and scans will resolve to an inactive network notice.
• Subscription Plans: Software subscriptions are billed automatically on a recurring monthly or annual basis based on the selected tier (Starter $19.99/mo, Pro $34.99/mo, Business $74.99/mo). Subscriptions may be cancelled at any time prior to the next billing cycle.
• Non-Refundable Hardware: Due to custom laser engraving and pre-encoding specific to your business and Google Place ID, hardware setup fees are non-refundable once production or dispatch has commenced.

3. Acceptable Use Policy

You may not access or use the services for any purpose other than that for which we make the services available. Specifically, you agree NOT to:

• Use the hardware to route users to malicious websites, phishing scams, or explicit content.
• Violate the Terms of Service of third-party platforms we integrate with (such as Google). Note: "Review gating" (filtering negative reviews) is strictly against Google's policies.
• Attempt to reverse engineer, duplicate, or clone the NFC hardware or routing software.

4. Limitations of Liability

GrowTap acts solely as a routing mechanism. We are not responsible for, nor do we have control over, third-party platforms such as Google My Business. GrowTap shall not be held liable if your Google Business Profile is suspended, penalized, or otherwise altered by Google.

Furthermore, we are not responsible for lost, stolen, or physically damaged NFC hardware once delivered to you. Replacement hardware will require a new purchase.

5. Modifications to Service

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.
